Free Web Design Online is working with the auDA.
The Terms Of Service agreement for Free Web Design Online has been updated.
Plans and policies are continuing to be worked on.

As has previously been stated, there was some confusion over the auDA policy.
In terms of the organisational structure, Free Web Design Online was not set-up as a non profit organisation, but it does specifically service not for profit and community organisations, such as sporting clubs and the like.
Due to the predicted level of growth, it (the organisational structure,) probably will not change.
The number and the range of services offerd by Free Web Design Online will continue to expand within the next 12 to 18 months.

According to the auDA site, there are no exceptions with who can be in the possession of a .org.au domain.

From their site (auDA > Domains > .au Second Level Domains (2LDs)

As has already been stated, there was some confusion (on my part) as to the published policies.
Also, you need to be a registerd organisation on the day when the register the domain name, these checks were not done by Jumba / AussieHQ on the day when the domain name was registerd through them.
I am not blaiming Jumba / AHQ, I am just saying that their was perhaps some confusion on both parts. As what seamed obvious to us was not obvious when you go strictly by the policies outlined by the auDA.

The auDA policy is quite complex, as an example they say that .com.au domains are for "comercial use" yet non profit organisations who are registerd but they are not comercial organisations, but they can still be used by non profit organisations.

The tuff part about that is, some non profit organisations register themselves as PTY LTD's. So technically they are companies but they are not. It all starts to get a bit technical.

But in case you have not noticed, I have a service to provide and would rather focus on that, and as I have already said I am quite happy to work with the auDA and other parties, in order to both provide and improve that particular service.
